Why a licenced contractor?

You have seen the horror stories on television: homeowner taken by friendly contractor offering to build an extension/replace a roof/re-pave a driveway/repair an air conditioner etc., quickly and at a bargain price. The media never tells you the really scary part. Most people do not know the liability they open themselves up to by using an unlicensed contractor. They are usually interested only in price. They can wind up losing everything they own.

In Florida, using an unlicensed contractor is a misdemeanor. You can be fined for aiding and abetting a criminal act.

If an unlicensed contractor takes your money, there's usually no way you can get it back. If they work out of their truck, they're long since gone. If the contractor does shoddy work that has to be redone, you wind up paying twice. Don't try to sue. The contract, if you have one, is illegal and therefore unenforceable. If the contractor or an employee injure themselves while working on your premises you may discover there is no insurance or workman's compensation coverage. YOU are the responsible party. Insurance companies will not pay since the so called "contract" is illegal. A personal injury law suit can wipe you out. Is it worth it just to save a few bucks?

When you select a contractor, do your home work. Are you dealing with a state certified contractor? Get a copy of the license. Does the contractor carry adequate insurance? Get a copy of the policy. You can check with the state, county, insurance company and better business bureau. If local permits are required, get copies of these permits for your files. Pay in stages. Get copies of paid bills for materials used in case suppliers try to put a lien on your property for non-payment by contractor.

The state has a recovery fund of up to $25,000.00 for jobs done by licensed contractors if the job is done improperly or is in violation of industry standards. Working with licensed professionals is the only assurance you have that the job will be properly done and that you will be protected against personal liability.
